EvoForce Terms of Service

1. Acceptance of Terms
By accessing or using EvoForce ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including Business Owners, Employees, Sales agents, and Clients.
2. Description of Service
EvoForce is a cloud-based SaaS platform providing event management tools, including booking, scheduling, client portals, sales pipelines, payments, timelines, playlists, and analytics for event professionals (e.g., photographers, videographers, venues, DJs, caterers).
3. Account Registration
You must create an account to use the Service and be at least 18 years old. You agree to:
- Provide accurate, complete information
- Keep your credentials secure
- Be responsible for all activity on your account
- Notify us immediately of unauthorized use
4. Subscriptions and Payments
Subscriptions are billed monthly or annually in advance. You authorize recurring charges to your payment method (processed via Stripe). Subscriptions auto-renew unless canceled at least 24 hours before renewal.
Failed payments may result in suspension after a 7-day grace period.
Refunds are at our discretion; contact support within 30 days of charge for consideration. Prices may change with notice.
5. Acceptable Use
You agree not to:
- Use the Service for illegal purposes or violate laws
- Infringe intellectual property or rights of others
- Transmit viruses, malware, or harmful code
- Attempt unauthorized access, reverse-engineer, or scrape the Service
- Resell, sublicense, or redistribute the Service without written permission
- Overload or disrupt the Service
6. Intellectual Property
The Service, including software, design, branding, and content (excluding your data), is owned by EvoForce. We grant you a limited, non-transferable license to use the Service per these Terms. You may not copy, modify, or create derivatives.
7. Your Data
You own your uploaded data (bookings, client info, playlists, etc.). You grant EvoForce a worldwide, royalty-free license to host, process, and display it solely to provide and improve the Service. You are responsible for backups; we recommend regular exports.
8. Limitation of Liability
The Service is provided "as is" without warranties. To the fullest extent permitted by law, EvoForce shall not be liable for indirect, incidental, consequential, or punitive damages, or lost profits/data. Our total liability shall not exceed amounts paid by you in the 12 months prior.
9. Indemnification
You agree to indemnify and hold EvoForce harmless from claims arising from your content, use of the Service, or violation of these Terms.
10. Termination
We may suspend or terminate your account for violations, non-payment, or at our discretion with notice. Upon termination, access ceases immediately. You may export data within 30 days; we may delete it thereafter.
11. Modifications to Service or Terms
We may modify features or the Service with reasonable notice. Material changes to Terms will be notified via email or in-app; continued use constitutes acceptance.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration in Delaware on an individual basis (no class actions), administered by the American Arbitration Association. You waive rights to jury trial or class proceedings.
13. Force Majeure
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, cyberattacks, third-party outages).
14. Miscellaneous
These Terms constitute the entire agreement. If any provision is unenforceable, others remain valid. No waiver unless in writing.
15. SMS Terms
If you provide a phone number for SMS updates, you consent to recurring operational texts from EvoForce about bookings, reminders, assignments, contracts, and account activity. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Support: support@evoforce.app.
